Not quite. Thesis can easily remove the copied code. But presumably any law suit would be to force all future releases to have a GPL license.

Well, sort of. Chris changed to GPL which means that Matt won the argument (sort of) and it was out of court.

Matt didn't win shit really. I would say the whole thesis mess is a loss to the community.
The true nature of many in the WP community was revealed as being bullies.

Bullies lol, pretty funny considering Chris Pearson's past which is well documented. Not that dipping to his level makes things any better. It's not a loss really in the hopes that it's one less thing that will be talked about and argued to death in the coming weeks/months. I suppose we could go even further and start arguing the fact that even though the theme is split licensed, it's not like he gives two shits about it all.

1 person vs many people. Bad behavior is bad behavior. Matt mentioning skittzo as an example that he knew what Chris faced is ludicrous to say the least.
WP Community has taken a road to the worse since what is acceptable behavior within the overall community (as ppl that follow these things) has been lowered.
